General Terms & Conditions – Curacao Waggies

These General Terms & Conditions (“Terms”) apply to all vehicle rental agreements between the car rental company (“Curaçao Waggies”, “we”, “us”, or “our”) and the renter (“Renter”, “you”, or “your”). By booking or renting a vehicle through our website or directly with us, you agree to these Terms.

# 1. Eligibility & Driver Requirements
1.1 The renter and any additional driver must:
* Be at least 22 years old;
* Hold a valid driver’s license for a minimum of 2 years;
* Present a valid passport or identification document;
* Present a valid credit card or accepted payment method.
1.2 International driving permits may be required for licenses not issued in Latin characters.
1.3 Only drivers registered in the rental agreement are permitted to drive the vehicle.

# 2. Reservations & Payments
2.1 Reservations are subject to vehicle availability and confirmation by the Company.
2.2 The Company reserves the right to refuse or cancel a reservation at its discretion.
2.3 Rental charges, optional extras, taxes, fees, and the security deposit must be paid before or at the start of the rental period.
2.4 Payments may be made by credit card, debit card, cash, or other approved payment methods.

# 3. Security Deposit / Own Risk
3.1 A refundable security deposit / own risk amount of USD 360 applies to every rental.
3.2 The deposit may be pre-authorized or charged before the vehicle is released.
3.3 The deposit will be refunded after the vehicle is returned and inspected, provided:
* No damage or loss has occurred;
* No traffic fines or penalties are outstanding;
* The vehicle is returned in accordance with these Terms.
3.4 In the event of damage, negligence, traffic violations, or breach of these Terms, the Company may deduct applicable costs from the deposit.

# 4. Insurance Coverage
4.1 All vehicles include all-risk insurance coverage.
4.2 The renter remains responsible for the own risk amount of USD 360 per incident.
4.3 Insurance coverage does not apply in cases including, but not limited to:
* Driving under the influence of alcohol or drugs;
* Reckless or dangerous driving;
* Unauthorized drivers;
* Driving outside permitted areas;
* Intentional damage or gross negligence;
* Violation of local traffic laws.
4.4 Damage to tires, rims, windshield, interior, lost keys, or undercarriage damage may not be fully covered unless specifically stated otherwise.

# 5. Vehicle Use
5.1 The renter agrees to:
* Use the vehicle responsibly and carefully;
* Lock the vehicle when unattended;
* Use the correct fuel type;
* Comply with all Curaçao traffic laws and regulations.
5.2 The vehicle may not be used:
* For racing, competitions, or illegal activities;
* To transport illegal substances or goods;
* For commercial transport without written permission;
* Off-road or on unsuitable terrain;
* To tow other vehicles unless authorized.

# 6. Delivery & Return
6.1 Vehicles may be delivered and collected at agreed locations, including Curaçao International Airport, hotels, apartments, or other approved locations.
6.2 The renter must return the vehicle:
* On the agreed date and time;
* In the same condition as received, excluding normal wear and tear;
* With the agreed fuel level.
6.3 Late returns may result in additional charges.
6.4 If the vehicle is returned excessively dirty, damaged, or with missing items, cleaning or replacement fees may apply.

# 7. Fuel Policy
7.1 The fuel policy will be specified in the rental agreement.
7.2 If the vehicle is returned with less fuel than provided, refueling charges and service fees may apply.

# 8. Accidents, Damage & Breakdown
8.1 In the event of an accident, theft, or damage, the renter must:
* Notify the Company immediately;
* Contact local police if required;
* Complete any accident or incident reports requested;
* Cooperate fully with insurance procedures.
8.2 The renter may not admit liability or settle claims without the Company’s written consent.
8.3 Roadside assistance is available for technical breakdowns not caused by renter negligence.
8.4 Costs resulting from negligence, misuse, lost keys, flat batteries, or incorrect fuel usage may be charged to the renter.

# 9. Traffic Fines & Violations
9.1 The renter is fully responsible for all parking fines, traffic violations, tolls, towing costs, and related administrative fees incurred during the rental period.
9.2 The Company reserves the right to charge the renter for any unpaid fines received after the rental period.

# 10. Cancellation & Refund Policy
10.1 Cancellation requests must be submitted in writing.
10.2 Refund eligibility may depend on the timing of cancellation.
10.3 No refunds will be provided for unused rental days after the rental has started.
10.4 The Company reserves the right to cancel bookings due to force majeure, safety concerns, or unforeseen circumstances.

# 11. Liability
11.1 The Company is not liable for:
* Loss or damage to personal belongings left in the vehicle;
* Delays caused by breakdowns, weather, accidents, or force majeure;
* Indirect or consequential damages.
11.2 The renter is liable for all damages not covered by insurance or caused by violation of these Terms.

# 12. Privacy
12.1 Personal information provided during booking and rental may be used for:
* Reservation management;
* Payment processing;
* Customer communication;
* Insurance and legal obligations.
12.2 The Company will handle personal data in accordance with applicable privacy laws.

# 13. Governing Law
13.1 These Terms are governed by the laws of Curaçao.
13.2 Any disputes arising from the rental agreement shall be subject to the jurisdiction of the competent courts of Curaçao.

14.1 The Company reserves the right to amend these Terms at any time.
14.2 The version published on the website at the time of booking applies to the rental agreement.
